Child Support in the Age of Covid

A lot of people are concerned about not being able to pay their monthly child support ( or getting paid what is owed to them) during this crises.  Under normal circumstances, filing a motion to modify the child support is the only way to lower or change the child support due under a Texas Order.  Even if the case does not result in decision for many months, either party can argue for retroactive adjustment back to the date of filing or service.  The real question is what is going to happen in the age of the Corona Virus?  If you owe child support and are making less or are getting some type of benefits, then I would advise to make at least some payment each month until you either get your job back or file a motion to modify.  The future is unclear, is it possible the State could waive some amount of past due support due to the crisis?  Or at least lesson the severity of the penalties associated with not complying with your order?  Nobody knows, yet.  I will let you know we start processing these cases in the future.
